Dear all,

After receiving demands from various quarters and with recommendations of the 44th, 45th and 46th Session of Indian Labour Conference (LIC) Ministry of Labour and Employment, Govt.of India has enacted the Maternity Benefit (Amendment) Act, 2017 with clarification to the amendment related queries, issued for all the Labour Dept. of all states / union territories on dtd 12.04.2017. The soft copy of the amendment with related clarification is attached herewith for your kind reference.

The following are the salient features added to the Maternity Benefit Act, 1961:

  1.  Maternity leave available to working women has been increased from 12 weeks to 26 weeks with less than two  surviving children.
  2.  Provisions provided to nursing mothers to work from home.
  3.  All establishments with more than 50 employees need to provide crèche facilities for working mothers.
  4.  Maternity leave of 12 weeks available to mothers adopting a child from the date the child is handed over as well as to  the ‘commissioning mother’.

Provisions of the Amendment Act have come into force w.e.f. 1st April, 2017, except those relating to crèche facility which shall come into force from 01.07.2017.
