PROPOSED AMENDMENT IN CONTRACT LABOUR (REGULATION AND ABOLITION) CENTRAL RULES

Dear members,

Your association has enclosed herewith a Notification No. G.S.R. 368 (E), dtd 30.03.2016, published in the Gazette of India, Extraordinary, Part II - Section-3 -sub sec (1).

The notification is issued by the Ministry of Labour and Employment, New Delhi, by Ministry has proposed to amend the Contract Labour (Regulation and Abolition) Central Rules 1971.

Vide the said Notification the Ministry has proposed the certain amendment as mentioned in the draft rules.  

The said amended Draft Rules are mentioned here-in-under.

       1.  (1) These may be called the Contract Labour (Regulation and Abolition) Central
            (Amendment) Rules, 2016
            (2) They shall come into force on the date of their publication in the Official Gazette.
      2.   In the Contract Labour (Regulation and Abolition) Central Rules. 1971, in rules 25, in sub
            rules (2), for clause
            (iv), the following clause shall be substituted, namely –
                “(iv) the rates of wages payable to workmen by the contractor shall not be less than
                     (a)   the rates prescribed under the Minimum Wages Act.1948  (11 of 1948) for such
                     employment
                     where applicable; or
                     (b)    the rates, if any, fixed by agreement, settlement or award; or
                     (c)    Ten thousands rupees
                     Whichever is higher.”

Ministry has invited public objections/suggestions in respect this amendment. It is to be ensured that the said objections/suggestions should reached to the Joint Secretary  to the Government of India-cum-Director General (Labour Welfare),Jaisalmer House, 26, Mansingh Road, New Delhi-110011 latest by 29th April 2016.

So, colleague industries are hereby requested to send their suggestions/objections to your association SIMA latest by 20th April 2016 to enable your association to compile all the objection/suggestions before the appropriate authority in prescribed time limit.
