Compliance under the Transgender Persons (Protection of Rights) Act, 2019, Important Circular
Dear all,
Your Association, SIMA, is forwarding herewith the Circular dated 25.05.2026 issued by the Department of Labour & Employment, Dadra & Nagar Haveli and Daman & Diu, regarding compliance with the provisions of the Transgender Persons (Protection of Rights) Act, 2019.
The Labour Department has informed that every establishment is required to designate a Complaint Officer to address complaints relating to violation of the rights of transgender persons. Also, to frame and implement an Equal Opportunity Policy for transgender persons, ensuring non-discrimination in employment, workplace safety, dignity, and equal access to opportunities.
The Department has observed that many establishments have not yet complied with these requirements and has therefore directed all industries, establishments, and organizations to take immediate necessary action.
It is also advised to Display the details of the designated Complaint Officer prominently at the workplace and submit a compliance report to the Labour Department, Dadra & Nagar Haveli, Silvassa.
SIMA appeals to all industries to carefully review the enclosed circular and take the necessary steps to ensure compliance with the provisions of the Transgender Persons (Protection of Rights) Act, 2019.
